Agriculture Real Estate
Agriculture is one of the most regulated industries in the United States. At Lachman PLC, we provide counsel for all sizes and types of farms and agricultural businesses in Michigan. Between crop insurance disputes, non-insured crop disaster claims, loans, contracts, and other associated business problems, we recognize that today’s farmers and producers need effective representation and can help you with a variety of agricultural real estate problems you could face.
Noninsured Crop Disaster Claims: The Noninsured Crop Disaster Assistance Program grants relief to farmers whose crops have been damaged in a natural disaster. Our team can file a claim on your behalf so that you can acquire any compensation from the losses of the disaster.
Contract Drafting and Disputes: We help producers plan, draft, and review contracts to mitigate problems before they occur. If you have an ongoing dispute, we are prepared to negotiate on your behalf until the matter is settled.
Environmental, U.S. Environmental Protection Agency and Michigan Department of Environment, Great Lakes, and Energy Issues: Our attorneys can assist producers with water or environmental issues that arise and help you to navigate changing government policies so you can maintain your operations. These can include:
- Working with the USDA Environmental Quality Incentives Program to provide financial assistance to producers who have established conservation practices.
- Advising and negotiating disputes with the USDA and directing farmers with wetland conservation management on or near production areas. This can be extremely useful in determining the direction of any production activities. In some cases agricultural production on former wetlands is prohibited.
- Working with the USDA Natural Resources Conservation Service to negotiate monetary payouts through programs such as the Conservation Stewardship Program and develop contracts to limit fund reduction over time.
