Restrictive Covenants
Restrictive covenants exist in real estate to prohibit the use of a property in a certain manner by tenants, homeowners, or other occupants. The intent of a covenant is to help preserve the use of land so that it can be maintained and enjoyed. Restrictive covenants are commonly used by homeowners’ associations and condominium associations and outline the rules of an established planned community. Restrictive covenants can cover things such as:
- Architectural guidelines (styles, colors, construction materials, etc)
- Building height, width, and placement on property
- Fence height
- Flagpole height and flag size
- Landscaping
- Maintenance
- Minimum setback lines
- Minimum home size (square footage)
- Number of bedrooms
- Outbuildings
- Property use (business and rental use)
- Swimming pools
- The number and type of vehicles allowed on the property
- The number of people who can occupy the property
